Three artists file a class action over training data
Sarah Andersen, Kelly McKernan, and Karla Ortiz filed a class action against Stability AI, Midjourney, and DeviantArt, alleging copyright infringement and violations of the right of publicity over the use of their work in the training data behind Stable Diffusion, Midjourney, DreamStudio, and DreamUp. It was the first suit in which creators organised to challenge a generative AI company's ingestion of their work directly. Less than five months after the weights were published, the decision to publish them was a question for a court. The copyright cases that followed — the lyrics suit in October 2023, the New York Times filing in December — all run along this line.
